The legal regulation of environmental standards is a key instrument of state policy in the field of environmental protection. Environmental norm-setting involves the establishment of norms by authorized state bodies that ensure the sustainable functioning of ecosystems, conservation of biodiversity, and rational use of natural resources. It covers both environmental quality standards and permissible impact standards on nature, non-compliance with which entails the application of legal enforcement measures.
The main goal of environmental regulation is state regulation of the impact of economic and other activities on the natural environment. This is achieved through the development of environmental quality standards, permissible impact standards, natural resource extraction quotas, and other regulatory documents. Such a system allows minimizing environmental risks and ensures protection of public health as well as preservation of natural capital for future generations.
Norms and documents of environmental regulation are developed based on modern scientific data, technological achievements, and international standards. Their adoption and implementation are carried out in accordance with the decrees of the Government of the Russian Federation, such as Decree No. 469 and Decree No. 183, regulating permissible emissions, discharges of substances, and physical impacts on various natural environments, including water and atmospheric air.
The differentiated approach to environmental regulation allows for setting norms separately for atmospheric air, water bodies, and soils. However, as experts note, such an approach does not always prevent cross-media pollution when harmful substances move between natural environments. In this context, integration of regulation and comprehensive impact assessment on ecological systems as a whole is important.
Article 20 of the Federal Law "On Environmental Protection" regulates the process of developing standards: conducting scientific research, expert review, approval and publication of standards, monitoring compliance, and maintaining a unified database. Such a systematic approach ensures transparency in standardization, forecasting environmental and socio-economic impacts, and forming an effective legal basis for protecting the environment.
