Land Use Zoning
Land use zoning is a type of urban planning activity (paragraph 1 of Article 1 of the Urban Planning Code of the Russian Federation), which consists in zoning territories of municipal formations for the purpose of defining territorial zones and establishing urban planning regulations (paragraph 6 of Article 1 of the Urban Planning Code of the Russian Federation).
Land use and development rules are a document of land use zoning, which is adopted by normative legal acts of local self-government bodies, normative legal acts of state authorities of subjects of the Russian Federation - cities of federal significance Moscow and St. Petersburg, and in which territorial zones, urban planning regulations, procedures for applying such a document and procedures for making changes to it are established (paragraph 8 of Article 1 of the Urban Planning Code of the Russian Federation).
Territorial zones are zones for which boundaries are defined and urban planning regulations are established in land use and development rules (paragraph 7 of Article 1 of the Urban Planning Code of the Russian Federation).
The urban planning regulation refers to the permitted uses of land plots within the boundaries of the corresponding territorial zone, as well as everything located above and below the surface of land plots that is used during their development and subsequent operation of capital construction objects, maximum (minimum and/or maximum) sizes of land plots, and maximum parameters of permitted construction and reconstruction of capital construction objects, restrictions on the use of land plots and capital construction objects, as well as, with respect to territories within whose boundaries activities for comprehensive territorial development are planned, calculated indicators of the minimum acceptable level of provision of the corresponding territory with communal, transport, and social infrastructure, and calculated indicators of the maximum allowable level of territorial accessibility of these objects for the population (paragraph 9 of Article 1 of the Urban Planning Code of the Russian Federation).
