Peoples


1. This Convention applies:
a) to peoples leading a tribal way of life in independent states, whose social, cultural, and economic conditions distinguish them from other groups within the national community and whose situation is regulated wholly or partially by their own customs or traditions, or by special legislation;
b) to peoples in independent states who are considered indigenous because they are descendants of those who inhabited the country or geographical area of which this state is a part during its conquest or colonization or during the establishment of existing of state borders, and which, regardless of their legal status, retain some or all of their social, economic, cultural, and political institutions.
2. The designation by the peoples themselves of their belonging to the category of indigenous or leading a tribal way of life is considered a fundamental criterion for determining groups to which the provisions of this Convention apply.
3. The use of the term "peoples" in this Convention is not regarded as carrying any particular meaning in relation to rights that may be implied by this term under international law.
