General Provisions

Public environmental monitoring is an important tool for implementing citizens' right to a favorable environment and preventing violations of environmental legislation. It is carried out by citizens, public associations, and non-profit organizations within the scope of their charter activities, and the results of the monitoring must be subject to mandatory consideration by state authorities and local self-government bodies.

Functionally, public environmental monitoring combines elements of environmental management and a type of environmental oversight aimed at monitoring compliance with environmental norms, detecting violations, and informing government agencies. This contributes to enhancing transparency and accountability in environmental protection.

Public oversight enables citizens and organizations to participate in the protection of natural resources, creating an additional level of supervision over the activities of enterprises and government authorities. It stimulates compliance with environmental requirements and the implementation of measures to reduce negative impact on the environment.

The development of public environmental supervision in Russia faces challenges such as low environmental literacy among the population, insufficient readiness of citizens to protect their rights, weak organizational structures of public associations, and limited legal knowledge of oversight participants. These factors hinder its effectiveness and scope.

Despite the challenges, public environmental monitoring plays a key role in shaping a culture of ecological responsibility. Improving the legislative framework, increasing citizens' legal literacy, and supporting public initiatives help enhance the effectiveness of oversight and contribute to sustainable development and environmental protection.

According to Article 68 of the Federal Law «On Environmental Protection», public control in the field of environmental protection (public ecological control) is carried out with the aim of implementing the right of each person to a favorable environment and preventing violations of legislation in the field of environmental protection. Public control in the field of environmental protection (public ecological control) is conducted by public associations and other non-commercial organizations in accordance with their charters, as well as citizens in accordance with legislation. environment (public environmental monitoring), submitted to federal government bodies, regional government bodies of the Russian Federation, and local self-government bodies, must be subject to mandatory consideration in accordance with the procedures established by legislation.

According to A.K. Golichenkov, public ecological oversight is: 1) a function of public ecological management; 2) a type of ecological control; 3) (for purposes of the Federal Law "On Environmental Protection") ecological control carried out by public associations and other non-commercial organizations in accordance with their charters, as well as citizens in accordance with legislation, in order to realize the right of each person to a favorable environment and prevent violations of legislation in the field of environmental protection1.

According to N.V. Kichigin, in the field of environmental protection, public ecological oversight, like many other areas, unfortunately is underdeveloped. There are several reasons for this: weak environmental awareness among citizens, reluctance to defend their environmental rights, poor organization, and lack of legal knowledge2.
