Act
Action is considered to have been committed innocently if the person who committed it was unaware and, given the circumstances of the case, could not be aware of the social danger of their actions (omission) or did not foresee the possibility of socially dangerous consequences and, given the circumstances of the case, should not have or could not have foreseen them1.
Action is also considered to have been committed innocently if the person who committed it, although they foresaw the possibility of socially dangerous consequences of their actions (omission), could not prevent these consequences due to the mismatch between their psychophysiological characteristics and the requirements of extreme conditions or neuro-psychological overload2.
